    Read another blounder-catastrophic decision by the Supreme Court of Puerto Rico - May, 2005 Farinacci's case, where he was disbarred and his name stricken from the attorney's roll, he practiced law during his disbarment, didn't show any remorse for what he did, convicted, he plead guilty before the US District Court of Connecticut and without any remorse, was reinstated: OHH GOD! HOW DO YOU SAY? "WHAT HAPPENS TO US PUERTO RICO"?

    Matter: Application for Reinstatement

    RESOLUTION
    San Juan, Puerto Rico, a January 28,2005.

    Jorge Farinacci-Garcia was admitted to the professional practice on January 3,1974.

    On April 30,1993 we ordered his suspension from the legal practice, due to his conviction before the U.S. District Court of the U.S. for the District of Connecticut for committing felony crimes transporting stolen money to foreign country and for conspiracy.

    On October 9,2000, after extinguishing his punishment, Farinacci-Garcia applied reinstatement to practice law, which we denied.

    On March 2,2001 Farinacci-Garcia applied again for reinstatement.In this ocassion we referred the application to the Committee. After the proceeding took place, on August 12, 2003 the Committee recommended favorable said application, which was backed by the General Solicitor of Puerto Rico.

    On November 14,2003 we ordered the Clerk of the Court to transcribe the hearing before the Committee.

    Examined very carefully the transcription and remaining documents appearing therein, we understood that there were no enough fundaments to discard the recommendation given by the General Solicitor and the Committee for Farinacci-Garcia for him to be reinstated.

    For the above, it is authorized his reinstatement of Jorge Farinacci-Garci­a to the practice of law.

    Dissenting-Associate Justice REBOLLO-LOPEZ

    Eventhough we sympathize with the application for reinstatement of Jorge Farinacci-Garci­a to practice law in Puerto Rico, our conscience bars our endorsement. We are conscious that Farinacci-Garci­a has a good reputation in the society where he lives. Second, we are of the criteria that he even complies with the requirements of rehabilitation; the above from the point of view that Farinacci-Garci­a honestly understand that, due to the existing circumstances, today in our Country, there is no need for him or for other be involved in analogus criminal activities in those he was involved and for which he plead guilty. However, we are convinced that according to the evidence admitted before the Committee clearly demonstrated that Farinacci-Garci­a continued functioning properly as for practicing law during the time while he was disbarred. This appears from the transcribed record from his own testimony and the one from Mr. Jorge L. Cruz-Negron, president of Seafarer International Union also from Atty.Vivian Godileaux, Esq., also from a Stipulation held amongst the parties, that was proposed by Farinacci-Garcia's lawyer,  Atty. Leonardo Delgado. Lets see: To the interrogatory of Atty.Leonardo Delgado, representing Farinacci-Garci­a, and from Atty. Alcides Oquendo-Solis, Special Solicitor for the Committee, the President of the Seafarer International Union declared, in its pertinent testimony, what follows: ...... "Convicted for a federal felony crime, practiced the legal profession while disbarred, and showed no remorse, reinstated"? You must be kidding kid.



    " This is really an outrageous decision. The Supreme Court of Puerto Rico reinstated for the practice of law, Jorge A. Farinacci. It's very important to read the dissenting opinion"
